Terms of Service

1. Acceptance of Terms

By accessing or using GetVibeCast.Live ("the Service"), operated by Alan Thompson ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

GetVibeCast.Live provides animated chat overlay tools for live streamers. The Service integrates with third-party platforms including Twitch and YouTube to display live chat as interactive visual overlays in broadcasting software such as OBS.

3. Eligibility

You must meet the minimum age requirements of Twitch, YouTube, and Google to use the Service. By using the Service, you represent that you meet these requirements.

4. Account and Authentication

To use the Service, you must authenticate via Twitch and/or YouTube (Google) OAuth. You are responsible for maintaining the security of your accounts on these platforms. You agree not to share your overlay URLs with anyone who might misuse them.

We are not responsible for any unauthorised access resulting from your failure to protect your account credentials.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to interfere with, compromise, or disrupt the Service or its infrastructure
• Reverse-engineer, decompile, or attempt to extract the source code of the Service (beyond what is publicly available)
• Use the Service to harass, abuse, or harm others
• Automate access to the Service in a manner that exceeds reasonable use or places undue load on our systems

6. Third-Party Services

The Service relies on third-party platforms including Twitch, YouTube, and Google. Your use of these platforms is governed by their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.

By using the YouTube features of our Service, you also agree to be bound by the YouTube Terms of Service and Google Privacy Policy.

7. Intellectual Property

All content, design, and code comprising the Service are owned by Alan Thompson. You may not copy, modify, distribute, or create derivative works from any part of the Service without prior written permission.

You retain ownership of your own stream content. We claim no ownership over your chat messages, overlay configurations, or broadcast content.

8. Service Availability

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice.

9. Limitation of Liability

To the fullest extent permitted by law, Alan Thompson and GetVibeCast.Live shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or profits, arising out of your use of the Service.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without prior notice. You may stop using the Service at any time by revoking access through your Twitch and/or Google account settings.

11. Referral Programme

GetVibeCast.Live offers an optional referral programme that allows users to earn additional free trial days by referring new users to the Service.

• Bonus trial days are awarded when a referred user signs up with a Twitch account that has at least 10 followers.
• Each new user can only count as one referral. Duplicate or fraudulent signups (including creating multiple Twitch accounts to generate referrals) are not permitted.
• Bonus trial days are non-transferable and apply only to the referring user's account.
• We reserve the right to revoke referral rewards and/or suspend accounts if we determine the programme is being abused.
• We reserve the right to modify or discontinue the referral programme at any time without prior notice.

12. Paid Subscriptions and Billing

GetVibeCast.Live offers paid subscription plans (Monthly, Annual, and Lifetime) that unlock additional features beyond the free tier. All payments are processed securely by Stripe. By purchasing a subscription, you agree to the following:

• Recurring subscriptions (Monthly and Annual) will automatically renew at the end of each billing period unless cancelled. You may cancel at any time from your dashboard; access continues until the end of your current paid period.
• Lifetime access grants access to the Service for as long as it remains commercially and financially viable to operate. If the Service is permanently discontinued due to financial unsustainability or other circumstances beyond our control, lifetime access will end at that point. No partial refunds will be issued for lifetime purchases in this event.
• Refunds for subscription payments are handled in accordance with Stripe's policies and applicable consumer protection laws.
• We reserve the right to change pricing for future billing periods. Any price changes will not affect your current active billing period.

13. Email Communications

During onboarding, you may provide your email address and optionally consent to receive tips and feature updates from us. If you opt in, we will send you periodic emails about the Service. You can unsubscribe at any time by clicking the unsubscribe link included in every email, or by contacting us directly.

We may also send essential account-related emails (such as your overlay link) regardless of your marketing preferences.

14. Changes to These Terms

We may update these Terms of Service from time to time. Any changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
